These Terms of Service apply to your use of nicecreamlondon.com and to purchases made through our website.
By placing an order with us, you agree to these Terms together with any other policies that apply to your purchase, including our Refund Policy, Shipping Policy and Privacy Policy.
Nothing in these Terms affects any statutory rights that you have as a consumer.
2. USING OUR WEBSITE
You must use our website only for lawful purposes.
You must not attempt to interfere with the operation or security of the website, introduce malicious software, obtain unauthorised access to any part of the website, scrape or harvest data without permission, or use our website or content in a way that infringes our or another person's rights.
We may restrict or suspend access to the website where reasonably necessary for security, maintenance, fraud prevention or legal reasons.
3. PLACING AN ORDER
When you place an order, you are making an offer to purchase the products in your basket.
An automated order confirmation acknowledges that we have received your order but does not necessarily mean that we have accepted it.
Unless we tell you otherwise, a contract between you and us is formed when we confirm that your order has been dispatched.
We may decline or cancel an order before dispatch where reasonably necessary, including where:

a product is unavailable;

there has been an obvious pricing or product-information error;

payment has not been authorised;
-
we reasonably suspect fraud or misuse;
-
delivery is not available to the address supplied; or
-
an order breaches a promotional restriction that was clearly disclosed.
If we cancel an order after taking payment, we will refund the amount paid for the cancelled goods.
Please check the information supplied at checkout carefully. You are responsible for providing an accurate delivery address, email address and telephone number.
4. PRODUCTS AND PRODUCT INFORMATION
We take reasonable care to ensure that product descriptions, measurements, materials, prices and photographs are accurate.
Colours may appear slightly differently depending on your screen or device.
Some jewellery incorporates natural or semi-natural materials, including freshwater pearls. Natural variations in colour, shape, texture and surface characteristics can occur and are not necessarily defects.
Measurements are approximate unless expressly stated otherwise.
Nothing in this section affects your rights where a product is faulty, not as described or otherwise fails to meet applicable consumer-law requirements.
5. JEWELLERY CARE AND NORMAL WEAR
Our jewellery should be cared for in accordance with the care guidance supplied with the product and/or published on our website.
Unless specifically described as waterproof, our jewellery should not be exposed unnecessarily to water, perfume, lotions, cleaning products or other chemicals.
Plated jewellery can naturally show signs of wear over time. The rate of wear will depend on factors including frequency of use, storage, exposure to moisture or chemicals and individual skin chemistry.
Normal wear and tear, accidental damage and damage caused by misuse or failure to follow reasonable care instructions are not necessarily manufacturing faults.
This does not affect your statutory rights where goods are not of satisfactory quality, fit for purpose or as described.
6. PRICES AND PAYMENT
Prices are shown in the currency selected on our website and include VAT where applicable.
Delivery charges and any other applicable charges will be displayed before you complete checkout.
Prices may change from time to time, but a change will not affect an order that we have already accepted.
If we discover an obvious pricing error before accepting your order, we may contact you to give you the option to purchase at the correct price or cancel the affected item and receive a refund.
Payment is processed through the payment methods made available at checkout. Those services may be provided by third-party payment providers and may also be subject to their own terms.
7. PROMOTIONS, DISCOUNT CODES AND COMPLIMENTARY GIFTS
Promotions may be subject to additional terms displayed at the time of the offer.
Unless stated otherwise, promotional codes cannot be combined and have no cash value.
Where a complimentary gift is offered subject to a minimum spend, the qualifying spend and any conditions will be made clear as part of the promotion.
If products are subsequently returned and the retained order no longer meets the qualifying spend for a complimentary gift, we may, where this was clearly disclosed as part of the promotion and is permitted by law, require the complimentary gift to be returned unused or adjust the refund to account for its stated value.
Promotional terms do not affect statutory consumer rights.
8. DELIVERY
Delivery options, estimated delivery times and charges are set out in our Shipping Policy and at checkout.
Delivery dates and transit times are estimates unless we expressly describe a service as guaranteed.
We are not responsible for delays caused by events outside our reasonable control, but this does not affect any rights you may have where delivery is materially delayed or does not take place within a period required by applicable law.
UK customers
For UK consumer orders, goods remain at our risk until they are delivered into the physical possession of you or another person identified by you to receive them, except where applicable law provides otherwise.
If you expressly instruct us or the delivery carrier to leave your parcel in a particular safe place or with a nominated neighbour or other recipient, and those instructions are followed correctly, delivery to that nominated location or person may be treated as completed delivery to the extent permitted by applicable law.
Where a parcel has been delivered in accordance with safe-place or alternative-delivery instructions specifically provided or authorised by you, we are not normally responsible for loss or theft occurring after that delivery has been completed.
If you have not authorised a safe place or alternative recipient and a carrier leaves a parcel unattended which you subsequently cannot locate, please contact us promptly so that we can investigate the delivery.
Nothing in this section limits any rights you have under applicable consumer law.
Customers outside the UK
For customers outside the UK, the point at which risk transfers will depend on the law applicable to the transaction.
Where permitted by applicable law, a carrier's confirmed delivery to the delivery address supplied by the customer, or to a safe location or nominated recipient authorised under the delivery service or by the customer, may constitute completed delivery.
If tracking shows that an international shipment has been delivered but you cannot locate it, please contact us promptly. We will review the available tracking information and, where appropriate, raise an enquiry with the carrier.
A refund or replacement is not automatic where a carrier has confirmed valid delivery and evidence indicates that the parcel was subsequently lost, removed or stolen after delivery. Any such case will be considered using the available evidence and subject to applicable consumer law.
We may require a signature or other enhanced delivery service for certain orders or destinations.
9. MISSED, REFUSED OR UNCLAIMED INTERNATIONAL DELIVERIES
Customers are responsible for monitoring their tracking information and responding to reasonable contact from the carrier or customs authorities where necessary to complete delivery.
If an international parcel cannot be delivered because the customer:

has supplied an incorrect or incomplete delivery address;
-
refuses delivery;
-
fails to respond to customs or carrier requests;
-
fails to collect the parcel within the carrier's collection period; or
-
otherwise prevents delivery through an act or omission within their control,
the parcel may be returned to us or, in some jurisdictions, abandoned or destroyed by the carrier.
Where permitted by law, reasonable and evidenced additional transport, return, customs or carrier charges incurred as a direct result may be deducted from any amount otherwise refundable.
This section does not affect your rights where the delivery failure was caused by us or by circumstances for which applicable law makes us responsible.
10. INTERNATIONAL DUTIES AND TAXES
The treatment of customs duties and import taxes depends on the destination and delivery service.
Where our website or checkout states that duties and taxes are paid by Nice Cream London, we will arrange the shipment on that basis for the ordinary duties and taxes covered by the relevant service.
For destinations or services where duties and taxes are not included, the customer may be responsible for import duties, taxes or customs fees charged by the destination country.
The applicable position will be displayed in our Shipping Policy or at checkout.
11. CANCELLATIONS AND RETURNS
Please see our Refund Policy for full instructions on making a return.
Statutory cancellation rights
Where applicable consumer law gives you a right to cancel an online purchase, those rights apply regardless of anything in our voluntary returns policy.
For UK consumers, this will normally include the right to notify us that you wish to cancel an eligible online order within 14 days of receiving the goods, subject to statutory exceptions.
You will then normally have a further 14 days to return the eligible goods.
If a UK consumer cancels their entire eligible online order within the statutory cancellation period, we will refund:
-
the price paid for the eligible returned goods; and
-
the cost of our least expensive standard outbound delivery option, where required by law.
If you selected an enhanced or more expensive delivery service, such as express or next-day delivery, we are not required to refund the additional amount paid above the cost of our least expensive standard delivery option.
Original delivery charges are not normally refundable where only part of an order is returned, as the delivery service has still been used for the items retained.
The requirement to refund standard outbound delivery applies specifically where required under statutory cancellation rights. It does not mean that original delivery charges are refundable on every return made under our voluntary 30-day returns policy.
Our voluntary 30-day returns policy
In addition to statutory rights, we currently offer an extended returns period of up to 30 days from receipt for eligible products.
Products returned under our voluntary policy must be unworn, unused, in their original condition and, where applicable, returned with original packaging, hygiene seals and security tags intact.
For returns made solely under our voluntary extended policy after any statutory cancellation period has expired, original delivery charges are not refundable unless we expressly agree otherwise.
Conditions applying to returns made outside a statutory cancellation period, including restrictions on sale or final-sale products, form part of our voluntary returns policy.
The fact that a product is discounted or on sale does not remove any statutory cancellation or faulty-goods rights that apply by law.
12. EARRINGS AND HYGIENE SEALS
For hygiene reasons, earrings are supplied with a tamper-evident hygiene seal where applicable.
Please do not remove or break the hygiene seal unless you are happy to keep the earrings.
Earrings returned under our voluntary returns policy must be completely unworn and have all applicable hygiene seals intact.
Where applicable law provides an exception to cancellation rights for sealed goods that are unsuitable for return for health-protection or hygiene reasons, that cancellation right may cease once the relevant hygiene seal has been removed or broken after delivery.
This does not affect your rights if the earrings are faulty, damaged, incorrectly supplied or otherwise fail to meet statutory requirements.
13. SECURITY TAGS ON NECKLACES AND BRACELETS
Selected necklaces and bracelets may be supplied with a security or returns tag.
For returns made under our voluntary extended returns policy, any security tag supplied with the product must remain attached, intact and untampered with.
Please only remove the tag once you are happy to keep the item.
Where statutory cancellation rights apply, your legal rights are not automatically excluded by this voluntary-return condition. However, where permitted by law, we may make an appropriate deduction from a refund if the value of an item has been reduced by handling beyond what was reasonably necessary to establish its nature, characteristics and functioning.
Items showing evidence of wear, contamination or damage may therefore result in a reduced refund where the law permits.
This does not affect rights relating to faulty goods.
14. FAULTY, DAMAGED OR INCORRECT GOODS
All goods supplied by us must meet the standards required by applicable consumer law.
For UK consumers, this includes rights relating to goods being of satisfactory quality, fit for purpose and as described.
If you believe your item is faulty, damaged or incorrect, please contact care@nicecreamlondon.com with your order details and, where possible, photographs of the issue.
Your statutory remedies may include a repair, replacement, price reduction or refund depending on the circumstances and applicable law.
Our returns policy, jewellery-care guidance, hygiene rules and any commercial warranty do not limit statutory rights relating to faulty goods.
15. REFUNDS
Approved refunds will normally be made to the original payment method.
Refund processing times after we issue a refund may depend on your bank, card provider or payment service.
Where a UK consumer cancels an entire eligible online order within the statutory cancellation period, we will refund the cost of our least expensive standard outbound delivery option where required by law.
If a customer selected a more expensive delivery method, we are not required to refund the additional cost above our least expensive standard option.
Original outbound delivery charges are not normally refundable:
-
where only part of an order is returned;
-
where the return is made solely under our voluntary extended returns policy after the statutory cancellation period has expired; or
-
in other circumstances where applicable law does not require us to refund them.
Where we are legally entitled to make a deduction for diminished value, return costs or another specific charge, we will explain the deduction.
Any voluntary store credit or goodwill resolution offered by us does not affect statutory rights unless expressly agreed as part of settling a particular dispute.
16. EXCHANGES
We do not offer exchanges for change of mind, including for a different size, colour or style.
If you would like a different item, please return the original item in accordance with our returns policy and place a new order separately.
If an item arrives damaged or is confirmed to be faulty, please contact us at care@nicecreamlondon.com and we will arrange the appropriate resolution, which may include a replacement where available.
This does not affect your statutory rights.
17. GIFT CARDS AND STORE CREDIT
Gift cards and store credit may be subject to additional conditions shown when issued or purchased.
They cannot normally be exchanged for cash and are non-refundable except where required by applicable law.
If a refund is being made for an order originally paid using a gift card or store credit, the relevant amount may be returned to the same form of payment.
18. PRE-ORDERS
Products described as pre-order items may have an estimated dispatch or availability date.
These dates are estimates and may change due to manufacturing, transport or other circumstances outside our reasonable control.
If a material delay occurs, we will provide an update where reasonably practicable. Any cancellation rights provided by applicable law remain unaffected.
19. INTELLECTUAL PROPERTY
The content of this website, including Nice Cream London branding, logos, text, photographs, graphics, videos, product imagery, product names and original designs, is owned by or licensed to Nice Cream London Ltd unless stated otherwise.
You may use the website for your own personal, non-commercial shopping purposes.
You must not copy, reproduce, distribute, commercially exploit or create derivative commercial content from our protected material without our prior written permission, except where the law allows it.
20. REVIEWS, PHOTOGRAPHS AND OTHER CONTENT YOU PROVIDE
If you submit a review, photograph, testimonial or other content to us for publication, you confirm that you have the right to provide that content and that it does not infringe another person's rights.
Where you expressly submit content for us to use or publish, you grant us a non-exclusive licence to reproduce and display that content for the purposes communicated to you.
We will not claim ownership of your content merely because you contact us or send us customer-service correspondence.
We may remove content from our website where reasonably necessary, including where it is unlawful, abusive, misleading, infringing or unrelated.
21. THIRD-PARTY SERVICES AND LINKS
Our website may use or link to services provided by third parties, including Shopify, payment providers, delivery companies and social-media platforms.
Where you choose to use a third-party service, that provider may apply its own terms and privacy practices.
We are not responsible for the independent content or operation of third-party websites that we do not control.
Nothing in this section excludes responsibility that the law places on us for performing our own obligations to you.
22. PRIVACY
Our collection and use of personal information is described in our Privacy Policy.
We use personal information where necessary to process orders, arrange delivery, provide customer service, prevent fraud and carry out other lawful business activities.
Marketing communications are sent in accordance with applicable law and the preferences you have provided.
23. EMAIL AND SMS MARKETING
If you choose to subscribe to marketing emails or SMS messages, participation is voluntary and is not a condition of purchasing from Nice Cream London.
Message frequency may vary and mobile-network charges may apply.
You can unsubscribe from email marketing using the unsubscribe link in our emails.
For SMS marketing, you can follow the opt-out instructions contained in the relevant message, including replying STOP where that functionality is supported.
Service messages concerning an existing order may still be sent where necessary to fulfil the order or communicate important information about it.
Additional Mobile Terms may apply where displayed when you subscribe.
24. OUR RESPONSIBILITY TO YOU
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
In particular, nothing excludes or limits:

liability for death or personal injury caused by our negligence;

liability for fraud or fraudulent misrepresentation; or
-
your statutory consumer rights.
If you are purchasing as a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was entered into or losses caused by circumstances for which we are not legally responsible.
Products purchased by consumers are supplied for private use. We are not responsible for business losses such as loss of profit, loss of revenue or loss of business opportunity arising from a consumer purchase.
Nothing in these Terms is intended to remove any remedy that applicable consumer law gives you.
25. EVENTS OUTSIDE OUR REASONABLE CONTROL
We are not responsible for delay or failure caused by an event outside our reasonable control where the law permits.
This may include serious transport disruption, customs disruption, natural disasters, industrial action affecting third-party networks, telecommunications failures or government restrictions.
If such an event materially affects your order, we will take reasonable steps to minimise the impact and communicate with you where appropriate.
This does not affect any statutory right you may have to cancel because of a substantial or prolonged delay.
26. FRAUD, ABUSE AND REFUSAL OF ORDERS
We may refuse, hold or cancel an order where we reasonably believe this is necessary to prevent fraud, misuse of a promotion, resale contrary to clearly stated restrictions, unlawful activity or a security risk.
We will exercise this right reasonably and in accordance with applicable law.
If we cancel an order that has been paid for but has not been supplied, we will refund the relevant payment unless we are legally entitled to withhold it.
27. WHOLE AGREEMENT AND SEVERABILITY
These Terms, together with the policies and information expressly incorporated into them, set out the terms applying to purchases through our website.
If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply where practicable.
If a consumer term could reasonably have more than one meaning, it will be interpreted as required by applicable consumer law.
28. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our business, website, services or legal requirements.
Changes will apply from the date the updated Terms are published.
Changes will not retrospectively alter the terms of a contract for an order that we have already accepted unless the change is required by law or you expressly agree to it.
29. GOVERNING LAW AND JURISDICTION
These Terms and contracts between you and Nice Cream London Ltd are governed by the laws of England and Wales.
If you are a consumer living outside England and Wales, nothing in this clause deprives you of any mandatory consumer protections that apply to you under the law of the country or territory in which you live.
Nothing in these Terms prevents a consumer from bringing proceedings in any court in which applicable law gives them the right to do so.
